論民事執(zhí)行權(quán)的性質(zhì)
摘 要
民事執(zhí)行權(quán)的性質(zhì)，主要是指該權(quán)力的國(guó)家分權(quán)屬性，即在國(guó)家的基本權(quán)力類(lèi)型中，民事執(zhí)行權(quán)所屬的類(lèi)別，其在實(shí)踐中表現(xiàn)為司法性和行政性的雙重特征。分析民事執(zhí)行權(quán)的性質(zhì)，對(duì)于完善民事執(zhí)行理論，合理設(shè)置民事執(zhí)行機(jī)關(guān)、科學(xué)規(guī)范民事執(zhí)行程序、保障司法公正具有重要的指導(dǎo)意義。

ABSTRACT

The analysis civil enforcement powers kind is important, for the leading meaning that the perfect civil case carry out the theories, reasonable to establish the civil case to carry out the organization, science the norm civil case to carry out the procedure, guarantee the judicatory fair.
