論民事執行權的性質
摘 要
民事執行權的性質，主要是指該權力的國家分權屬性，即在國家的基本權力類型中，民事執行權所屬的類別，其在實踐中表現為司法性和行政性的雙重特征。分析民事執行權的性質，對于完善民事執行理論，合理設置民事執行機關、科學規范民事執行程序、保障司法公正具有重要的指導意義。

ABSTRACT
