論土地承包經(jīng)營(yíng)權(quán)出租
摘 要
土地承包經(jīng)營(yíng)權(quán)出租是指土地承包經(jīng)營(yíng)權(quán)人將土地承包經(jīng)營(yíng)權(quán)出租給他人（包括單位和個(gè)人）經(jīng)營(yíng)，他人支付土地租金的行為�，F(xiàn)階段，出租作為土地承包經(jīng)營(yíng)權(quán)流轉(zhuǎn)的重要方式，在我國(guó)普遍存在并且出現(xiàn)了大量的問(wèn)題。而理論界對(duì)土地承包經(jīng)營(yíng)權(quán)能否出租，出租與轉(zhuǎn)包是否為同1法律概念分歧不斷，土地承包經(jīng)營(yíng)權(quán)出租的立法規(guī)定也較為混亂，進(jìn)而使得土地承包經(jīng)營(yíng)權(quán)出租實(shí)踐中的問(wèn)題得不到有效解決。根據(jù)當(dāng)前存在的問(wèn)題，立法機(jī)關(guān)在以后的立法過(guò)程中，1定要強(qiáng)化土地承包經(jīng)營(yíng)權(quán)的物權(quán)性質(zhì)，厘清土地承包經(jīng)營(yíng)權(quán)出租法律關(guān)系主體，明確出租雙方權(quán)利與義務(wù)，制訂詳盡的出租操作規(guī)程，以到達(dá)農(nóng)民承包地自愿、規(guī)范、有序、依法出租的目的。

ABSTRACT
