春秋時(shí)期成文法頒布的背景分析
摘 要
春秋時(shí)期是1個(gè)由習(xí)慣法向成文法過渡的時(shí)代，春秋各國(guó)的制度基本都是繼承西周而來(lái)，隨著宗法制度的逐漸崩潰，舊社會(huì)統(tǒng)治秩序的紊亂，原來(lái)以習(xí)慣法與刑罰相結(jié)合的制度已不能適應(yīng)社會(huì)出現(xiàn)的變化格局，各諸侯國(guó)為適應(yīng)政治經(jīng)濟(jì)的變革與發(fā)展，法律制度也相應(yīng)的起了變化。新興地主階級(jí)將斗爭(zhēng)的矛頭指向以秘密專橫為特征的奴隸制法律制度，以保護(hù)私有財(cái)產(chǎn)為中心的成文法在各國(guó)陸續(xù)出現(xiàn)。新的法律體系取代了舊的法律制度，從而使中國(guó)的法制實(shí)現(xiàn)了從習(xí)慣法向成文法的轉(zhuǎn)化，使法律真正成為調(diào)整人們行為的社會(huì)規(guī)范，并為新興的封建生產(chǎn)關(guān)系建設(shè)起到了保障作用，推動(dòng)了中國(guó)歷史的發(fā)展。

Abstract
The Spring and Autumn Period was a transitional period that from the common law to the written law , the systems in various countries of The Spring and Autumn Period were basically inherit from the Western Zhou Dynasty. With the collapse of patriarchal system and the disorder of old society order，the original system which combined the common law and the penalty had not been able to adapt to the change that the appears in society. various feudal lords country for the adaption politics economy transformation and the development, the legal system also corresponding got up the change. The emerging landlord class began to against for slavery law system which take secret despotically as characteristic，the written laws which take protection of private property as the central appear one after another in the various countries. The new legal framework had substituted for the old one，and caused the transformation from common law to the written law. So the law became the social norm which could really adjusts people behavior, and it would protect the construction of the emerging feudalism productive relations, and promote the Chinese history development.
