刑事二審程序的若干問題研究
摘要
刑事第2審程序作為普通救濟程序是刑事訴訟的獨立程序，也是整個刑事訴訟程序的重要環(huán)節(jié)。它對于查清案件事實，正確適用法律，維護司法權威，具有重要意義。由于我國現(xiàn)行刑事訴訟法關于第2審程序的規(guī)定過于簡單、原則，相關司法解釋規(guī)定也較少，有很多地方需要完善和改進。因此有必要在堅持刑事2審終審制的基礎上，分析刑事2審程序制度建構(gòu)的價值基礎和功能，借鑒現(xiàn)代西方國家刑事2審制度的特點，針對我國刑事2審制度在立法和司法實踐中存在的問題，提出完善的建議和措施。

Abstract

It regarding investigates thoroughly the case fact, correctly is suitable the law, maintains the judicial authority, has the vital significance. Because our country present Law of Criminal Procedure about second trial procedure stipulation too simple, principle, the related judicial interpretation stipulation are also less, has very many places to need to consummate and the improvement. Therefore has the necessity in persisted criminal second trials trial in final the system in the foundation, the analysis criminal activity second trials procedures system constructs the construction the value foundation and the function, The model modern western nation criminal activity second trials systems characteristic, in view of our country criminal activity second trials systems the question which exists in the legislation and the judicial practice, puts forward the consummation proposal and the measure.
